Divya Delhi: Authorities in Uttar Pradesh have issued a stern warning to developers, saying that they must immediately cease delivering unfinished apartments to purchasers. This is part of a crackdown on irresponsible builders. A registered sale or lease agreement must be executed before possession can be offered. Additionally, all promised amenities must be in place before the unit can be considered fully completed. The purpose of the directive is to prevent new buyers from being coerced into accepting bare-shell flats, a practice that UP-Rera has condemned as illegal and a major breach of the law. The directive is issued under Section 37 of the Rera Act, 2016. In accordance with Sections 38 and 61 of the Rera Act, promoters who are discovered to have violated these regulations can face fines of up to five percent of the entire project cost, according to Mahendra Verma, secretary of UP-Rera. Developers in Uttar Pradesh are required by law to have various no-objection certifications before they can apply for an OC. These certificates include things like fire safety, dues clearance, and plans for common areas like pools, elevators, and parks.The location is examined by the Noida Authority once all requirements are fulfilled. Possession can only be legally transferred once OC is granted. Officials have stated that it is prohibited to transfer ownership without an OC.
