Supreme Court Stays Himachal DGP Transfer Order

Sanjay Kundu was given permission by the Chief Justice DY Chandrachud-led Supreme Court bench to petition the high court for a recall of its ruling on December 26. The Himachal Pradesh High Court's judgment requesting that the state government remove senior IPS officer Sanjay Kundu from his position as Director General of Police (DGP) was stayed by the Supreme Court today. The move was made to prevent him from impacting the investigation into the purported harassment of Nishant Sharma, a businessman from Palampur.
Kundu was given permission by the Chief Justice DY Chandrachud-led Supreme Court bench to petition the high court for a recall of its ruling on December 26. The high court was asked by the Supreme Court to decide the recall application in a matter of two weeks. The businessman had asked the High Court to get involved because he was constantly afraid of being killed and needed protection from powerful people.On Tuesday, Sanjay Kundu was demoted as the Himachal DGP and assigned to the position of Principal Secretary in the Ayush department.In order to make sure that "they didn't have an opportunity to influence the investigation," the Himachal Pradesh High Court had on December 26 ordered the State administration to move the DGP and Kangra Superintendent of Police Shalini Agnihotri to different positions before January 4, 2024.The panel ruled that Kundu's removal from the state DGP position would remain on hold until the high court resolved the recall application.
