Nepal PM KP Sharma Oli's Writ Petition: Why He's Accused of Contempt of Court

Divya Delhi: A writ suit against Nepal Prime Minister KP Sharma Oli has been filed at the Nepal Supreme Court accusing him of being in contempt of court for allegedly not executing the ruling of the supreme court. Advocate Om Prakash Aryal filed a writ against the Office of the Prime Minister and Council of Ministers and the Ministry of Land Management, Cooperatives and Poverty Alleviation for not following the Giribandhu Tea Estate ruling.The advocate's petition claims that Oli and Balaram Adhikari, the Minister for Land Management, created obstruction by introducing an ordinance. An ordinance was issued by the President's Office to circumvent the ruling and prohibit the verdict's execution. Advocate Aryal has previously filed a petition against Oli and Minister Adhikari. But the Supreme Court's Joint Registrar Achyut Kuinkel denied the plea. Aryal then filed the petition naming the and the Ministry of Land Management as defendants. Aryal's appeal, filed under Supreme Court Rules, 2017, demands action for the non-execution of a ruling given by the Constitutional Bench of the Supreme Court about the illegal use of land above prescribed ceiling. The ruling required the Nepal Government to reclaim land beyond the ceiling, recognized as unutilized or lying barren, in the name of the state.The issue centered around the lands of Giribandhu Tea Estate, which were discovered to have been plundered for purposes other than intended. The court ruled that the land has not been given to the government despite orders.Advocate Aryal said blocking the Supreme Court's directives is disrespect and a direct assault to the rule of law.Aryal asked the Court to act quickly against individuals involved and rule to stop additional violations of its directives. He asked for measures to ensure that the executive entities comply with judicial orders, as per the country's constitution.Aryal said the case hearing is set for February 16.
