Divya Delhi: A man accused of sexually abusing his seven-year-old daughter was granted bail by the Kerala High Court (HC) for suspected false implication. Justice C.S. Dias ruled in a Family Court case where the accused was given interim custody of his two children. The mother claimed the accused sexually molested the child during custody. However, the court noted that neither the kid nor the mother complained of abuse during custody, and the FIR was registered a week after custody had transferred to the mother. The prosecution claimed the accused had care of the survivor and his younger daughter for seven days from May 25 to May 31, 2024. They claimed he brought the survivor to a mall public washroom and caressed her genitals and penetrated her with his finger. The accused was charged under Sections 376 (rape), 376(2)(n) (repeatedly raping the same woman), and 376AB (rape on a woman under 12 years) of the Indian Penal Code, 1860, as well as Sections 3(b), 4(2), and 5(m), 5(l), and 5(n) of the Protection of Children from Sexual Offences (POCSO) Act. The petitioner's wife is using the survivor to avenge him, it was said. The petitioner said he is a law-abiding citizen and will help with the investigation. Thus, he asked anticipatory bail.
